New York Fries Bike and Cycling Jersey Package Contest

HOW TO ENTER: No Purchase Necessary. The "NEW YORK FRIES BIKE AND CYCLING JERSEY PACKAGE" contest begins on May 11, 2009 and ends at 11:59 pm EST on June 28, 2009 (the "Contest Period"). All entries must be submitted during the Contest Period. To enter, simply go to www.newyorkfries.com, click on the link to enter the "NEW YORK FRIES BIKE AND CYCLING JERSEY PACKAGE" contest, complete the information required (your name, Canadian address, telephone number with area code, and email address), click on the box indicating you have read and accept the rules and regulations then click on the "Send" button to automatically submit your entry. Only one (1) entry is permitted per email address during the Contest Period.

PRIZES: There are twenty-five (25) Prize Packages available to be won, each consisting of one (1) Mongoose Hybrid Bike and one (1) New York Fries cycling jersey (autographed by 3–Time Olympic Medalist Curt Harnett). Prizes will be shipped within 3 months of selected entrant being confirmed a winner. Retail value of each Prize package is approximately $600.00 (this amount does not include the value of the autograph or of shipping). LIMIT: one (1) prize per person.

ELIGIBILITY: Open to residents of Canada (except Quebec) who are natural persons who have reached the age of majority in their province or territory of residence before the start of the Contest Period or as of the date during the Contest Period when they submit their entry. You are not eligible if you are an employee, representative or agent of 122164 Canada Ltd. o/a New York Fries ("Sponsor"), its affiliates, subsidiaries, parent or related companies, advertising or promotional agencies, the independent judging organization, or if you are a member of the immediate family or household of any such employee, representative or agent. For these Contest Rules, "immediate family" means spouse, mother, father, son, daughter, sister and brother regardless of where they reside.

SELECTED ENTRANTS: A random draw will be made at 2:00 p.m. Eastern Standard Time (EST) on June 29, 2009, in Toronto, Ontario from all eligible entries. Odds of winning depend on the number of entries received. The first selected twenty-five (25) entrants will be contacted by phone by 5:00 p.m. EST on Monday, July 6, 2009. The Sponsor's representative must be able to speak with the selected entrant or leave a message at such entrant's phone number on a voicemail message system or with an adult of the same household by 5:00 p.m. EST on Monday, July 6, 2009, failing which the selected entrant shall forfeit all right to a prize and an alternate winner shall be chosen. If the Sponsor's representative is required to leave a message, the selected entrant must contact and speak with the Sponsor's representative no later than 5:00 p.m. EST on July 20, 2009. To be confirmed and declared a winner, the selected entrant must (a) speak with the Sponsor's representative no later than 5:00 p.m. EST on Monday, July 20, 2009; (b) correctly answer, without mechanical or other assistance, a time-limited arithmetical skill-testing question to be administered by telephone at a mutually agreeable time ; (c) be in compliance with these Contest Rules; and (d) sign and return postmarked no later than Friday, July 31, 2009, a declaration of compliance with these Contest Rules and a Release of Liability / Consent to Publicity form, releasing Sponsor, its affiliates, subsidiaries, parent and related companies, advertising or promotional agencies, and all of their respective directors, officers, shareholders, owners, partners, employees, agents, representatives, successors, and assigns (collectively, the "Releasees") from any liability in connection with this contest or the prize (including the use thereof). If a selected entrant cannot be contacted and confirmed a winner as described within the time limits set out above, he/she may be disqualified and the prize forfeited and awarded to an alternate entrant. By accepting a prize, winner consents to the use of his/her name, city of residence and statement for any publicity conducted by the Sponsor and in connection with this contest, without further compensation. Winners' names and cities of residence will be posted on www.newyorkfries.com.

RELEASE OF LIABILITY: By entering the Contest, entrants agree that the Releasees will not be responsible for:

  1. late, lost, stolen, damaged, incomplete, postage-due, unintelligible, illegible or misdirected entries or Confirmation Documents (being any documents required to be submitted by the winners to the Sponsor as part of the confirmation process) or entries or Confirmation Documents that are altered, contain false information or are otherwise irregular, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of these Contest Rules;
  2. any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including without limitation, printing or advertising errors;
  3. failure of or problems with any equipment or programming associated with or used in the Contest howsoever caused;
  4. failure of or problems with the Internet or a website at any time howsoever caused;
  5. problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software;
  6. failure, interruption, or delay of any entry or email or post to be transmitted or received or processed whether the failure is the result of technical or human error or for theft, unauthorized access to, destruction or alteration of entries;
  7. traffic congestion on the Internet or at any website or combination;
  8. injury or damage to an entrant's computer or to any other person's computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize;
  9. the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise.

DISPUTE REGARDING IDENTITY OF ENTRANT: If the identity of an entrant is disputed, the entry will be deemed to have been submitted by the "Authorized Account Holder". The person assigned to the e-mail address for the domain associated with the submitted e-mail address is considered to be the Authorized Account Holder. Entrant may be required to provide proof that he or she is the Authorized Account Holder of the e-mail address associated with the selected entry.

CONDUCT: By entering, entrants acknowledge that they have read and understood these Contest Rules and agree to abide by them, which are subject to change without notice to individual entrants, and all decisions of the Sponsor, which shall be final and binding in all matters relating to this Contest and the awarding of a prize. All personal information provided by an entrant must be truthful, accurate and complete. Entrants who have not complied with these Contest Rules are subject to disqualification.

GENERAL: All entries become the exclusive property of the Sponsor (and will not be returned), and are subject to verification by Sponsor. Entrants will not be individually contacted except for the twenty-five (25) selected entrants who will be contacted by telephone as described above. Any entry and any Confirmation Documents that are late, lost, stolen, damaged, incomplete, duplicated, postage-due, unintelligible, illegible or misdirected or that is altered or contains false information will be deemed invalid and shall void the entry and disqualify any winner of such entry. Sponsor reserves the right to substitute a prize of equal or greater value in the event that the prizes cannot be awarded as described. Sponsor will ship prizes only to Canadian addresses. Prizes are non-transferable, must be accepted as awarded by Sponsor, and may not be exchanged by a winner for cash or other substitutes. Sponsor reserves the right in its sole discretion and without prior notice to entrants to cancel, close, reinstate, modify (including closing any method of entry) or suspend the contest for any reason. The disqualification of an entrant, invalidation of an entry or refusal by an entrant to accept a prize releases and forever discharges the Sponsor and the other Releasees of all obligations to the entrant. This contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. The contest and these Contest Rules shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute shall be adjudicated in the courts sitting in Toronto, Ontario. Copyright in contest materials is owned by Sponsor.

PRIVACY: We respect your right to privacy. By entering the contest, entrants consent to the collection, use and disclosure of personal information for the purposes of administering the contest, including announcing the winners. Sponsor's Privacy Policy is available at www.newyorkfries.com.
